In 2018, the California Legislature passed SB 1437 which entitled persons convicted of murder to vacate their convictions if they were not the actual killer but were convicted of either murder under a felony murder theory or under a natural and probable consequence theory. What was unclear then was whether persons convicted of less serious crimes of attempted murder and manslaughter were also eligible for such relief. Beginning January 1, 2022 those who have suffered convictions for manslaughter or attempted murder under such circumstances may now also petition a court to vacate their convictions.
